Terms of service for international users
Status: draft. It has not been reviewed by a lawyer, and the places marked [ЗАПОЛНИТЬ: …] are still open. The general terms of service apply to everyone else.
These terms cover your use of the Transcrib Si service and the transcrib.si website from outside Russia. By creating an account, paying for a plan or sending us a file, you agree to them. If you do not agree, do not use the service.
1. Who you are contracting with
Transcrib Si operates a speech-to-text service. The contracting party is [ЗАПОЛНИТЬ: юридическое лицо, зарегистрированное наименование и адрес]. You must be old enough to enter a contract where you live, and at least 13 years old.
2. What the service gives you
You give the service an audio or video file, and it returns a transcript: the text, a timestamp per line, speaker labels when you ask for them, an editor, and an export. On top of that:
- REST API at api.transcrib.si — upload a file, read the transcript, patch the text, export it, check your usage, manage API keys. See the API reference.
- MCP server — four tools for assistants:
transcribe_audio,summarize_transcript,extract_actions,list_transcripts. The server does not keep chat history, does not accept conversation context and does not call third-party services. See the MCP page. - Export formats — TXT, Markdown, SRT, VTT, CSV and DOCX.
What the service does not do: it does not join your meetings, it does not read your inbox, and it does not write a summary unless you call the MCP tool that asks for one. We may add, change or remove features. We will not reduce the core function of transcribing files without telling you.
3. Accounts
- You need an email address and a password.
- One account per person, or one account per team. Do not share a login, do not sell access to an account, and do not let more people use it than the plan allows.
- Keep your password and your API keys to yourself. Tell us at once if you think a key has leaked, and we will revoke it.
- Give us accurate information and keep it accurate.
4. Plans, limits and fair use
| Plan | Price | What you get |
|---|---|---|
| Free | $0 | 3 files a day, up to 30 minutes and 64 MB per file. Transcripts are kept for 7 days. |
| Pro | $10 a month when billed yearly ($120 a year), or $20 a month when billed monthly | Fair use of 1,500 minutes of transcribed audio per calendar month, every export format including DOCX, API keys and MCP access, priority queue, full history. |
| Team | By written agreement | The committed volume, the seats and the terms we agree in writing. |
| API | Metered, billed by volume | Usage outside any subscription, at the published per-minute price. |
- File limits on every plan — 64 MB and 120 minutes (two hours) per file. A larger or longer file is rejected with a clear error, not processed halfway.
- No plan includes unlimited transcription. The numbers above are the numbers. We do not offer an "unlimited" plan, and we will not start calling the fair-use allowance unlimited.
- Reaching a limit is not a cancellation. The service returns a clear error that tells you what happened. Reaching the limit does not by itself cancel or suspend your account.
- The fair-use counter resets on the first day of each calendar month.
What fair use means
1,500 minutes a month is a real allowance, not a polite word for "as much as you like". It covers roughly 25 one-hour meetings, 33 meetings of 45 minutes, or 12 two-hour sessions. Beyond it, the request is refused with a clear error and the account stays open.
You agree not to:
- deliberately evade a limit, or split one account into several to obtain more allowance;
- share a login, or let people use your account beyond what the plan covers;
- resell or redistribute access to the service, or sell transcripts produced with it as a service of your own;
- batch-process large media libraries — for example re-encoding an archive of commercials, ad spots or a media library in bulk on a consumer plan. That work belongs on the Team plan, where the volume is agreed in advance;
- use the API or MCP access to build a competing product that uses our outputs in bulk without a written agreement.
If your volume grows past the allowance, the answer is a Team agreement or metered API, not a workaround.
5. Acceptable use
You agree not to use the service to:
- break the law, or process content that is illegal where you are;
- process content you do not have the right to process, including recordings made without the consent of the people in them where the law requires consent;
- impersonate someone, forge documents, or create deceptive content at scale;
- attack the service: no probing, no denial-of-service, no scraping for resale, no circumventing rate or volume limits, no uploading malware;
- reverse engineer the service or the transcription engine, except where the law explicitly allows it;
- upload content that infringes someone else's copyright, or use the service to harass or defraud.
6. Your content
- You keep all rights to the audio you upload and to the text we produce from it.
- You give us the limited right to process your content to run the service for you: to store it, transcribe it, and export it back to you. That permission ends when you delete the file or close your account.
- We do not use your content to train models for other customers, and we do not sell it.
- You are responsible for having the right to upload the content, and for the content itself. If you are a company transcribing your own calls, that includes the consent of the people on the recording where your law requires it.
- We may suspend processing of a specific file if we are required to do so by law or if it is being used to break these terms. If that happens, we tell you why.
7. Payment, renewal and cancellation
- Paid plans renew automatically until you cancel.
- Yearly billing is charged once for the year. Monthly billing is charged every month.
- You can cancel at any time from the Billing section of the app or by writing to us. You keep the plan until the end of the period you have paid for.
- We do not offer refunds for periods already used, except where the law requires it. If we break a promise on our side, we will make it right.
- Failed payments are retried. If a payment cannot be collected, the account moves to the Free limits.
- Payments are processed by Stripe. Card details go to Stripe and never to us.
8. Suspension and termination
- You can close your account at any time. We delete your data as described in the privacy policy.
- We may suspend an account, in whole or in part, if you break these terms, if a payment fails, if we detect abuse or fraud, or if a law or a court order requires it. We will tell you why, and we will restore the account when the reason is gone.
- We may discontinue the service or a feature. We will give reasonable notice, and you can export your transcripts before that happens.
9. Who else touches your data
- Our own transcription infrastructure, which runs our engine and processes every file.
- A third-party cloud speech provider, in the United States, in one case only: a file that is entirely in English, when the cloud fallback is switched on for the service. It is a fallback, not the default path.
- Stripe, for payments and invoices.
- Our hosting and email providers, which run the servers and deliver messages.
Nobody else receives your data. The details, including retention periods and how to delete things, are in the privacy policy, and the commercial arrangement for a business customer is the Data Processing Agreement.
10. Accuracy, and the limits of what we promise
The service is provided as is. Transcription is an estimate, not a legal, medical or financial record, and mistakes happen — especially with names, numbers, technical terms, accents and overlapping speakers. Our engine makes errors; we do not promise 100 % accuracy and we will not put a guarantee of perfect transcripts in writing.
Read the transcript before you rely on it, and do not use it as the sole record of a legal, medical or financial decision. We do not warrant that the service will be uninterrupted, error-free, or that it will meet a particular accuracy target. Where the law does not allow us to exclude a warranty or a liability, that does not apply to you — your statutory rights remain intact.
11. Intellectual property
The service, its interface, our transcription engine, the name Transcrib Si and the logo belong to us. We own or license the technology we use. You may not copy the interface or the brand to build a look-alike service.
12. Indemnity
You agree to defend and hold us harmless if your use of the service, or content you upload, infringes the rights of someone else or breaks the law. [ЗАПОЛНИТЬ: юрист — проверить формулировку для потребительских договоров в ЕС/Великобритании, где возмещение убытков может быть ограничено]
13. Limitation of liability
To the fullest extent the law allows, our total liability arising from or connected with the service is limited to the amount you paid us in the twelve months before the event that caused the claim. We are not liable for lost profits, lost data, or indirect damages. Some jurisdictions do not allow these limits, in which case they apply as far as the law permits.
14. Governing law
These terms are governed by the laws of the United States of America, without regard to conflict-of-law rules. [ЗАПОЛНИТЬ: штат — владелец уточняет; в соглашении со стороной он не должен называться без проверки]. The state and federal courts located in the United States have exclusive jurisdiction over any dispute, and you agree to submit to them. If you are a consumer, this does not take away the protections that the law of your place of residence gives you.
15. Changes to these terms
We may update these terms. The effective date at the top shows the current version. If a change materially reduces your rights, we will tell you by email at least 30 days before it takes effect. Continuing to use the service after that means you accept the new terms.
